Waiver and Release of Liability
By checking the box below, I acknowledge and agree to the terms outlined in this Waiver and Release of Liability (the “Agreement”). This Agreement is entered into by me in favour of Toronto Film School, an organization owned and operated by Yorkville Education LP, its members, trustees, directors, officers, partners, employees, volunteers, agents, insurers and contractors (collectively, the “School”), for the summer academy held by the School (the “Summer Academy”). The Summer Academy is for campers to engage in activities related to Film Production, Acting and Video Game Design (the “Activities”).
I hereby give my permission for my child(ren) to participate in the Summer Academy and engage in the Activities, and for other good and valuable consideration, I agree to all the terms and conditions set forth in this Agreement.
I understand that my child(ren)’s participation in any program, including the Activities, which involves physical activity, exposes the camper to many risks, dangers and hazards. Accidents and injuries are always a possibility, and it is impossible to foresee and protect the camper from all conceivable dangers. I hereby affirm that my child(ren) has/have no conditions that would make it unsafe for him/her/them to participate in the Summer Academy program(s) selected.
Medical Consent and Release: I understand that the School will make every effort to contact me in the case of an emergency. I hereby give my permission for the School to administer any medications needed and to provide and arrange for and consent to any necessary medical treatment for my child(ren) while at the School, including onsite and offsite emergency care. I understand and agree that I am solely responsible for all costs related to such medical treatment, medical transportation, and/or evacuation. I hereby release, discharge and hold harmless the School from any claim whatsoever in connection with such treatment or other medical services.
Equipment Use Release (Film Academy only): I accept responsibility for any damage, loss or theft of equipment that may occur while equipment is in my child(ren)’s possession. I understand that I will be charged a non-refundable insurance fee of $100 and that in the case of any lost equipment or the repair of any damaged equipment, a further deductible up to the value of $2,500 may be charged at the discretion of the School.
Insurance: I understand that, except as agreed to by the School in writing, the School does not assume any responsibility for, or obligation to provide, financial assistance or other assistance, including medical, health, or disability insurance of any nature, or any fines, costs or expenses including legal fees, in the event of my child(ren)’s injury, illness, death or damage to or loss of property arising out of or resulting from the Activities.
Miscellaneous: I hereby agree that this Agreement represents the full understanding between the Organization and me and supersedes all other prior agreements, understandings, both written and oral, between us, with respect to the subject matter hereof. If any term or provision of this Agreement shall be held to be invalid by any court of competent jurisdiction that term or provision shall be deemed modified so as to be valid and enforceable to the full extent permitted. The invalidity of any such term or provision shall not otherwise affect the validity or enforceability of the remaining terms and provisions.
Governing Law: I hereby agree that this Agreement is intended to be as broad and inclusive as permitted, and that this Agreement shall be governed by and interpreted in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. The parties agree to the exclusive jurisdiction of the courts of the Province of Ontario for any and all disputes arising under this Agreement.
By signing this Agreement, with full appreciation of the risk involved, on my own behalf and on behalf of my child(ren), I acknowledge that I have read and understood all of the terms of this Agreement. I hereby voluntarily release and forever discharge the School from any and all legal or financial responsibility for any personal injury, disability, illness, damage, medical expense or death, arising from or related to my child(ren)’s participation in the Summer Academy. I agree, for myself and my child(ren), not to make any type of legal or equitable claim on the School with respect to any injury I or my child(ren) may suffer, whether or not it arises through the negligence, omission, default or other action of anyone affiliated with the School, including other campers. I further agree that if any such claim is made, I will indemnify and defend the School with respect to any such claim, injury or damage.
Photo Release
Photography Release: In consideration of my child(ren)’s participation at the School, and without any further consideration from the School, I hereby grant permission to the School, staff and affiliates to utilize my child(ren)’s appearance, performance or voice in any and all manner and media throughout the world for the purpose of promotion, reporting or publication. The School may use my child(ren)’s, likeness, voice, biographical material and image in connection with publication, promotion, exhibition and distribution of such material. I understand that no royalty, fee or any other compensation of any kind shall become payable to me by reason of such release and use of any photograph.
